| The Music Industry Declares War On R&B Haven | ||||
R&B Guru 2009-08-31 14:29:33 Total Posts: 2527 | Hey guys, I've been meaning to mention this to you for a while but unfortunately, have been busy and it slipped my mind. ASCAP (American Society of Composers Artists and Performers) has been emailing me telling me that we are required to pay them $500+ a year because we embed music videos on the site. While it's total BS (for the technophobes, embedding means that the video is not hosted here but instead, is displayed via a stream FROM the original site), since embedding is the equivalent to just linking to another web site, the Internet is still so new in law that they probably would win if they escalated it. Still, I figure we have a pretty big network here so if any of you happen to know somebody who knows somebody who's in law (esp. IP law) please ask them about the issue or get them to contact me with their generous free services :). Now, ranting about how silly this is since we serve as promotion and free marketing for hundreds of artists can commence. | |||

I'll be fighting it that's for sure, but the music video section will probably be forced to change (the videos will just become links to the videos for any sites that won't defend me) | |||

I'm going to ask them next time they email me what law exactly I'm breaking, so I might ask you to contact him once they cite one for me. But yea, it all seems so silly to me. Do you think ANYTHING on R&B Haven might HURT the R&B industry? Hell, I thought we were one of the few things keeping it going. | |||
ilikeit 2009-09-01 06:00:17 Total Posts: 1156 | I think the answer to this problem is that we should just direct people to where the video can be found on the internet and take out the embedd all together. By law ascap does have ground to stand on, whether we like it or not. Their job is to protect and collect for the artist. We have to keep in mind that even though the internet is still new there are still do's and don'ts when it comes to music. We can use the radio as example. We are not doing anything different than what the radio is doing and that is promoting music. Only difference is we did not get their blessing to do it. Our other option is if we want it to stay the same we should get better videos from the artist and I will pay for it $500 dollars a year max. LOL And we should get advertising money. | |||
R&B Guru 2009-09-01 07:33:50 Total Posts: 2527 | The problem ilikeit, is we're not ACTUALLY like the radio stations. The radio stations themselves are the ones playing the track for people to hear. We on the other hand, are like the barber who has the radio on while he cuts peoples hair. While he's "providing" the music for others, he's not directly responsible for the music and instead, the radio station is. The best example I could think of is a concert venue. Imagine an artist is performing at a concert at which you stand on the hillside above the venue and watch the show for free. Is it the artist's responsibility to go to these people and demand they pay (ASCAP in this case), or is it the venue's responsibility to ask these people for money (YouTube in this case). I have no problem paying for a service. However, the payments should not be made to ASCAP but instead, to YouTube/Yahoo/Imeem/DailyMotion as THEY are furnishing the service I am paying for. The fact that the content in their service is artists videos means that THEY should be paying the artists for every view these videos get, not me. | |||

I pay Blockbuster on the trust that they are removing this responsibility for me. In the same sense, I embed these videos which often have ads from the embedding company, on the trust that they are removing this responsibility for me (hence these sites statements that they let you use these videos royalty free). And note, I am not criticizing YouTube in this instance, as YouTube pays ASCAP 70,000$ a month for the use of their music videos. The problem is ASCAP wants to double dip by making the sites that use YouTube videos pay for those same views that are recorded on YouTube. | |||
